Terms of Use and Privacy Policy for the "Selge" Program

 

1. GENERAL

  1. The website selge.alkoinfo.ee is the environment for the web-based self-help program "Selge" aimed at reducing alcohol consumption.
  2. The free use of the "Selge" program materials in the selge.alkoinfo.ee environment is offered and managed by the National Institute for Health Development (hereinafter NIHD).
  3. These Terms of Use and Privacy Policy provide you with general guidance on how to use the selge.alkoinfo.ee website environment and what your and the environment provider's obligations are in this regard.
  4. The recommendations of the "Selge" program are consistent with the current state of knowledge from research on excessive alcohol consumption. However, we cannot take responsibility for the accuracy, precision, timeliness, and completeness of the information. The information presented is not definitive and may not be completely accurate.
  5. All recommendations shared in the selge.alkoinfo.ee environment are, to our knowledge, presented in accordance with best medical practices. However, following them should never contradict a doctor's advice. Following the recommendations of the "Selge" program presented on the website selge.alkoinfo.ee is at the User's own risk.
  6. The images of people used on the website and in the "Selge" program materials are legally obtained from an international image database. We have no information about the individuals depicted in the images and no reason to claim that they are excessive alcohol consumers.
  7. To use the "Selge" program materials, it is necessary to create a user account and log in to the selge.alkoinfo.ee environment as a user. By clicking the "Register" button, you confirm that you agree to all terms of use and privacy policy.
  8. If you do not agree to the terms of use, do not create a user account in the selge.alkoinfo.ee environment and do not click the "Register" button. By registering in the environment, you agree to all terms of use and privacy policy and create a selge.alkoinfo.ee user account.
  9. The privacy of user account creators is important to us. The general principles of personal data processing by the National Institute for Health Development are set out on the website http://www.tai.ee/et/instituut/andmekaitse.
  10. We are developing the selge.alkoinfo.ee environment to ensure that the service you use is the best. If you find any shortcomings in the Selge.ee environment, we would be grateful if you could provide feedback to selge@alkoinfo.ee.
  11. There may be interruptions in the use of the service (e.g., during software updates). We will notify you of any interruptions on the selge.alkoinfo.ee website if possible.
  12. The administrator of the environment reserves the right to terminate the operation of the selge.alkoinfo.ee environment and/or change, supplement, or delete its content at any time without prior notice.
  13. If we change the terms of use and privacy policy of the environment, we will notify Users at the email address provided by the User when registering the user account. If you do not agree to the changed terms of use and privacy policy but wish to access the data you have entered, you may submit a request to selge@alkoinfo.ee.
  14. When using the selge.alkoinfo.ee environment, the environment will send notifications to the email address provided by the User during user account registration. Since these notifications are an integral part of using the environment's content, it is not possible to "turn them off" in the environment.

 

2. RIGHTS AND OBLIGATIONS OF THE PARTIES

  1.  By creating a user account in the selge.alkoinfo.ee environment, you confirm that you will use your account yourself and are responsible for the accuracy of the data you provide, and you understand that the program offers recommendations based on the data you enter.
  2. As a User, you undertake to comply with these terms of use and legal obligations when using the account.
  3. The website administrator makes every effort to ensure a secure environment to protect information related to the user's account that the User has not publicly disclosed. The website administrator works to and makes every effort to protect your data, but is not responsible for the disclosure of data that has been disclosed from their account by someone else, as a result of a technical failure or cyberattack, or in any other way.
  4. The administrator of the selge.alkoinfo.ee website fully respects copyrights and expects the same from all its Users. All content and structure of the environment are protected by copyright and may not be reproduced for commercial purposes without prior written agreement with NIHD. Downloading or printing individual pages or documents for personal and non-commercial use is permitted. When publicly using materials on the page, a reference must be provided. Example of a recommended reference format: Web-based program "Selge" aimed at reducing excessive alcohol consumption. National Institute for Health Development. Website: www.selge.alkoinfo.ee.
  5. If you wish to publish personal alcohol quantities calculated using our program, you do not need to include a reference to the "Selge" program.
  6. The administrators of the selge.alkoinfo.ee website have the right to temporarily or permanently terminate the provision of the service, and in such a case, we will consider the Users' wishes and needs if possible. The administrator is not responsible for damages arising from the restriction or termination of access to the website.
  7. The administrator of the selge.alkoinfo.ee environment is not responsible for the preservation of data entered into the Environment.
  8. The administrator of the selge.alkoinfo.ee environment undertakes to protect the User's anonymity. The administrator will not provide information that could identify the User to third parties.
  9. The User is prohibited from testing, probing the technical structure of the selge.alkoinfo.ee environment or otherwise seeking or exploiting possible security vulnerabilities of Selge.ee, unless prior permission has been obtained from the selge.alkoinfo.ee administrator. In case of violation of this point, the selge.alkoinfo.ee administrator has the right to apply a contractual penalty of 10,000 euros, which may be supplemented by compensation for damages if this activity has caused material or non-material damage to the selge.alkoinfo.ee administrator or the User of the environment.
  10. The User is responsible for:
    • all information they enter into the environment or publish in any other way;
    •  observing copyrights for information entered into or published about the program;
    •  observing all behavioral recommendations received by them during the use of the program;
    • all information shared by the environment user related to their selge.alkoinfo.ee account.
  11. The User is responsible for ensuring that the password they use is secure (it is recommended to use uppercase and lowercase letters, and different letters, numbers, and symbols) and not easy to guess. Avoid using a password that is already used for another environment or application. The User undertakes to keep the password confidential. The selge.alkoinfo.ee administrator is not responsible if access to the account is gained because the User has not complied with all provisions of this point.

 

3. MODIFICATION OF TERMS OF USE

  1. These terms are valid until they are changed by the administrator of the selge.alkoinfo.ee website.
  2. If the terms of use or privacy policy are changed by the selge.alkoinfo.ee administrator, we will notify the User at the email address provided during user account registration.
  3. The User undertakes to keep the email address provided during registration for selge.alkoinfo.ee up to date. If selge.alkoinfo.ee has sent a notification to the email address provided by the User regarding changes to the terms of service, these will become effective and the User accepts them if they continue to use the Environment for more than a week after the relevant email has been sent to them.
  4. The rights and obligations of the parties directly arising from the use of the selge.alkoinfo.ee environment terminate with the deletion of the User's account.
  5.  ACCOUNT DELETION
    1. You can request the deletion of your selge.alkoinfo.ee account. To do this, you must send a letter to the contacts shown on the website.
    2. The administrator of Selge.alkoinfo.ee has the right to delete a User's account at their discretion if they deem it necessary to fulfill the objectives of the selge.alkoinfo.ee environment or to ensure compliance with its prevailing principles.
    3. We will notify you of the deletion of your user account at the email address provided during account registration.

 

4. WARNINGS AND LIMITATIONS OF LIABILITY

  1. By creating an account in the selge.alkoinfo.ee environment, the User understands that the website selge.alkoinfo.ee and its associated services, functions, applications, etc., are provided on an "as is" basis, meaning that the User has the right to use the Environment under the conditions provided by the selge.alkoinfo.ee administrator. By creating an account, the User agrees to all terms of use of the Environment.
  2. The administrator of the selge.alkoinfo.ee environment is not responsible for material or non-material damage resulting from the use of the page, caused to the User by third parties through the input, deletion, display, or other processing of information. Likewise, the administrator is not responsible for material and non-material damage caused by malware, cyberattacks, or other reasons.

 

6. OTHER TERMS

  1. All disputes shall be governed by the laws of the Republic of Estonia, and in case of litigation, the matter shall be resolved by Harju County Court.
  2. If you find any copyright infringement on selge.alkoinfo.ee, please notify selge@alkoinfo.ee.

 

7. PRIVACY POLICY

  1. These terms set out how and what data we collect and for what purposes we may use it.
  2. The institution authorized to process the data submitted in connection with the use of the selge.alkoinfo.ee environment and responsible for it is the National Institute for Health Development.
  3. For all questions regarding personal data or privacy policy, please contact andmekaitse@tai.ee.
  4. By creating and using a user account for the "Selge" program on the selge.alkoinfo.ee website, you provide the selge.alkoinfo.ee environment with your active email address and consent to receive emails to it. When choosing a username, we do not require unique personal data (first name or last name or date of birth or residential address) that would allow you to be identified. Please note that when registering an account, if you use your real name or other identifiable characteristic in your username or email address, your personal data may become known to the account administrator. Your personal data will not be forwarded to third parties.
  5. The National Institute for Health Development processes User's personal data for the following purposes:
    • To enable access to the "Selge" program web environment;
    • To ensure the functionalities of the "Selge" program;
    • To provide information to the User.
  6. Each time someone logs in or attempts to log in with an existing user account, the following technical data is automatically associated with the user account:
    • Login time
    • IP address of the logging-in client
    • Browser type, version, and operating system used (user agent)

We use this data to monitor unauthorized access attempts and to help with errors related to website usage.

      7. Each time a web page is downloaded in the environment, the following access data is collected and stored in the log file on our web server:

  • IP address of the logging-in client
  • Browser type, version, and operating system used (user agent)
  • Referrer URL
  • Server request time, path, and file name
  • Access mode and status

This data cannot be linked to a specific person. This data is not combined with other data sources. This data is processed for the following purposes:

  • Network infrastructure protection and technical administration
  • Optimization and troubleshooting when using the website
  • Detection and tracking of unauthorized access attempts
